Terms of Service

These Terms of Service ("Terms") govern your access to and use of Scaniam (scaniam.com), a SaaS platform for event surveys, gift distribution, and lead capture, operated by Red Qub Marketing Services (GSTIN: 19BJNPK5336C1Z4), West Bengal, India ("we", "us", or "Company").

By creating an account or using the service, you agree to be bound by these Terms. If you are accepting on behalf of a company, you represent that you have authority to bind that company.

1. The Service

Scaniam allows workspace owners ("Customers") to create events with survey forms, distribute gift codes to attendees, capture leads, and analyze event outcomes. The platform operates as a multi-tenant SaaS - each Customer has an isolated workspace. Access is tiered (Free, Starter, Premium, Enterprise) as described on the Billing page.

2. Account Registration

• You must provide accurate and complete information at registration.
• You are responsible for keeping your password secure and for all activity under your account.
• Each account has one workspace, used by one person. Team seats (several users in one workspace) are not available yet, unless we set them up for you.
• We reserve the right to refuse or terminate accounts that violate these Terms.

3. Subscriptions & Payment

Paid plans (Starter and Premium) are billed on a monthly subscription basis. All payments are processed by Razorpay. By subscribing, you authorize Razorpay to charge your selected payment method on a recurring monthly basis.

• Pricing: Displayed in USD or INR on the Billing page. Prices include applicable GST (18%) for Indian customers.
• Billing cycle: Monthly, from the date your subscription activates.
• Failed payments: If a renewal payment fails, your plan stays active while Razorpay retries it. If every retry fails, your plan stays active for 7 more days, counted from the end of your paid month or the day the last retry fails, whichever is later, and then moves to the Free plan. Your data is not deleted; responses above the Free plan's monthly limit stay locked until paid for.
• Plan changes: You can upgrade from the Billing page. An upgrade starts when its payment goes through and renews monthly from that day; unused days of the previous plan are not refunded. To downgrade, contact us; downgrades take effect at the end of the current billing period.
• GST invoices: For Indian subscribers, GST invoices are issued by Red Qub Marketing Services (GSTIN: 19BJNPK5336C1Z4) and sent by email.

4. Free Plan

The Free plan is provided at no charge and includes limited monthly responses. We may modify or discontinue Free plan features at any time with reasonable notice. The Free plan has no end date.

5. Acceptable Use

You agree not to use Scaniam to:

• Collect data from individuals without their knowledge or consent
• Violate any applicable law, including data protection laws (IT Act 2000 and DPDP Act 2023 in India, GDPR where applicable)
• Distribute spam, malware, or fraudulent content via surveys or gift codes
• Attempt to reverse-engineer, scrape, or otherwise compromise platform security
• Impersonate another company or individual
• Exceed plan limits by technical circumvention

We may suspend or terminate accounts that violate this policy without prior notice.

6. Data Ownership & Responsibility

You own your data. Survey responses, event data, and contacts collected through your workspace belong to you. We act as a data processor on your behalf. You are responsible for obtaining the necessary consents from your event attendees to collect and use their personal data.

We do not sell, rent, or share your data or your attendees' data with third parties for advertising. See our Privacy Policy for details.

Prize games and giveaways

If you run a prize game, contest, prize draw or giveaway through Scaniam, you are its promoter. You set its rules, decide who may take part, deliver the prizes and comply with the laws that apply to it. Scaniam provides the software only.

7. Intellectual Property

The Scaniam platform, its design, code, and branding are owned by Red Qub Marketing Services. These Terms do not grant you any intellectual property rights in the platform.

You retain all rights to the survey content, branding, and data you create in your workspace. You grant us a limited license to store and process that content solely to operate the service.

8. Uptime & Service Levels

We target 99.5% uptime but do not guarantee uninterrupted service. Planned maintenance is announced in advance where possible. We are not liable for downtime caused by third-party infrastructure (Firebase, Netlify, Razorpay) or force-majeure events.

9. Limitation of Liability

To the maximum extent permitted by law, Red Qub Marketing Services and its officers shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of data, or business interruption, arising from your use of or inability to use the service, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claims under these Terms shall not exceed the total fees paid by you to us in the three (3) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Red Qub Marketing Services from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the service, your violation of these Terms, or your collection or misuse of attendee data.

11. Termination

You may close your account at any time by emailing us at support@scaniam.com. We may suspend or terminate your access if you breach these Terms, with or without notice depending on severity. When your account is closed, it is switched off at once and your data is deleted 30 days later, except where retention is required by law.

12. Changes to the Service or Terms

We may modify these Terms or the service at any time. For material changes, we will provide at least 14 days' notice by email to registered users. Continued use after the effective date constitutes acceptance. If you disagree with changes, you may close your account before the effective date.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in West Bengal, India. We encourage you to contact us first to resolve disputes informally.
